Contingent vs Pending: What Each Listing Status Means
Contingent and pending both mean a seller has accepted an offer and the home is under contract. The difference is how close the deal is to closing. A contingent home still has conditions to clear, like an inspection or a loan approval. A pending home has cleared those conditions and is moving toward the closing table.
If you are shopping for a home in Nashville, these labels tell you whether a house is still worth a backup offer. If you are selling, they tell you how much risk is left in your deal. Below, we break down what each status means and how Nashville’s MLS labels homes that are under contract.
Contingent vs Pending at a Glance
| Contingent | Pending | |
|---|---|---|
| Accepted offer | Yes | Yes |
| Conditions left to meet | One or more | Usually none |
| Showings and backup offers | Often still allowed | Usually stopped |
| Stage of the sale process | Early, with more risk | Final preparations for closing |
What Does Contingent Mean in Real Estate?
A contingent sale is one where the seller has accepted an offer, but the purchase agreement depends on certain conditions being satisfied first. Each condition is a contingency. If one is not met by its deadline, the buyer can usually cancel the contract and get their earnest money back, depending on the contract terms.
Contingencies protect buyers from paying the agreed upon purchase price for a house with hidden problems or a mortgage loan that never gets approved.
Short sales are a special case. In a short sale, the home sells for less than the seller owes, so the seller’s lender has to approve the price before the deal can close.
Can a Contingent Home Accept Other Offers?
Often, yes. Many sellers keep showing a contingent home and keep taking backups in case the current offer falls apart. A backup offer is a signed contract that moves into first position only if the first buyer’s deal ends.
What Does Pending Status Mean?
Pending status means the contingencies have been satisfied or waived, and the deal is headed to closing. At this point, the inspection and appraisal are typically done, and the lender is working through final loan approval and closing documents.
Why a Pending Sale Is No Longer Actively Marketed
Once a home is pending, sellers usually stop showings and stop collecting other offers. The home is no longer actively marketed because the biggest hurdles are behind both parties. A pending sale can still fall through, but fewer conditions remain that would let a buyer walk away.
How Nashville’s MLS Labels Contingent vs Pending Homes
Here is something many buyers in Middle Tennessee do not know. Realtracs, the Nashville-based company that provides the largest MLS in Tennessee, lists two under contract statuses in its listing status definitions, and neither one is called contingent or pending.
- Under Contract-Showing (UCS): An offer has been accepted, but the home will still be shown to buyers who want to submit backup offers. This lines up with what most people call contingent.
- Under Contract-Not Showing (UCNS): An offer has been accepted and the home is no longer being shown. This is the closest match to pending, but Realtracs uses it regardless of any contingencies, so some conditions may still be open.
Realtracs requires listing agents to change the status within 48 hours of an accepted offer. National home search sites then translate MLS statuses into their own labels, so the wording you see online may not match the MLS exactly. A local agent can tell you where a specific home really stands.
Common Contingencies in a Home Sale
Most purchase agreements include more than one contingency. Here are the common contingencies buyers and sellers see in a typical real estate transaction.
Inspection Contingency
A home inspection contingency gives the buyer a set period to have the property inspected. If the inspector finds problems, the buyer can ask for repairs, negotiate a credit, accept the home as it is, or end the contract. In NAR’s September 2026 REALTORS Confidence Index, 20% of buyers waived the inspection contingency, which means most buyers still keep this protection.
Appraisal Contingency
An appraisal contingency protects the buyer if the home appraises below the contract price. Lenders such as Fannie Mae base the loan to value ratio on the lower of the sales price or the appraised value, so a low number can leave a gap the buyer has to cover. With this contingency, the buyer can renegotiate or cancel. NAR reported that 18% of buyers waived the appraisal contingency in September 2026.
Financing Contingency
A financing contingency, also called a mortgage contingency, lets the buyer back out if they cannot secure the loan described in the contract. Cash buyers do not need one, which is part of why sellers often see cash offers as lower risk.
Home Sale Contingency
A home sale contingency makes the purchase depend on the buyer selling their current home first. It helps buyers avoid carrying two mortgages at once, but it adds uncertainty for the seller, since the deal now rides on a second sale.
Title Contingency
A title contingency lets the buyer cancel if the title search turns up problems that cannot be fixed before closing, such as an unpaid lien or an ownership dispute.
What Is a Kick Out Clause?
A kick out clause lets a seller keep marketing a home after accepting an offer with a home sale contingency. If another buyer makes an acceptable offer, the seller notifies the first buyer, who then has a set window to remove the contingency and move forward. If the first buyer cannot, the seller can accept the new offer.
In Tennessee, sellers can use a Tennessee REALTORS addendum titled “Sellers’ Right to Continue to Market Property.” The number of hours the first buyer gets is filled in by the parties, so read that line closely before you sign.
What Happens If the Deal Falls Through?
When a deal falls apart, the home typically goes back to active status, or the seller moves to a backup offer if one is in place. NAR reported that 7% of contracts were terminated in the three months covered by its September 2026 survey, and 16% of contracts had a delayed settlement.
What happens to the earnest money depends on why the contract ended. If the buyer cancels under a contingency within its deadline, the money is usually returned. If the buyer simply defaults, the seller may be entitled to keep it. Your contract controls the outcome, so ask your agent to walk you through those terms.
How Long Does a Home Stay Contingent or Pending?
Each contingency has its own deadline, so the contingent stage lasts as long as the contract allows. Once those are cleared, the pending stage runs until closing. According to NAR’s September 2026 report, contracts typically closed in 30 days. Delays often come from loan approvals or repair negotiations. Appraisal issues alone caused delays on 5% of contracts in that same survey.

Contingent vs Pending: Frequently Asked Questions
Can I make an offer on a pending home?
You can ask, but most pending homes are no longer accepting other offers. Your agent can contact the listing agent to see whether the seller will take a backup offer.
Should sellers accept a contingent offer?
Usually, since most buyers include at least one contingency. The key is understanding which contingencies are in the offer and how long each one lasts.
Does contingent mean the home is sold?
No. A contingent home has an accepted offer, but it is not sold until closing is complete and the deed is recorded.
